Welcome to Nesty. By creating an account or using our Service, you agree to these Terms of Service ("Terms"). Please read them carefully.

  • "Nesty", "we", "our", or "us" refers to the provider of the Service at nestyapp.com.au.
  • "You" or "your" refers to the account holder or organisation using the Service.

1. The Service

Nesty provides a web-based platform that allows NDIS providers to publish and update accommodation vacancy listings on their websites via embed code.

We may update or improve the Service at any time. Major changes will be communicated in advance.

2. Accounts

  • You must provide accurate details when creating an account.
  • You are responsible for keeping your login details secure.
  • You are responsible for all activity under your account.

3. Subscriptions and Payment

  • The Service is billed on a subscription basis (monthly or annually, as selected).
  • Payments are processed through third-party providers.
  • Fees are inclusive of GST where applicable.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • All fees are non-refundable except as required by law.

4. Cancellations

  • You can cancel your subscription at any time.
  • Once cancelled, your website embed will stop displaying listings.
  • Your account data will remain available if you re-activate within 12 months.

5. Acceptable Use

You agree not to:

  • Use Nesty for unlawful, harmful, or misleading purposes.
  • Attempt to copy, modify, or reverse engineer the Service.
  • Interfere with or disrupt the Service or its security.

We reserve the right to suspend or terminate accounts that breach these terms.

6. Intellectual Property

Nesty and its content (software, branding, and design) remain our property. You retain ownership of the content you upload (property listings, images, descriptions).

7. Limitation of Liability

To the maximum extent permitted by law:

  • We are not responsible for any indirect, incidental, or consequential loss.
  • Our total liability for any claim is limited to the amount you paid us in the 3 months prior to the claim.

8. Data and Privacy

Your data is handled in line with our Privacy Policy at nestyapp.com.au/privacy.

9. Termination

We may suspend or terminate your account if you breach these Terms. You may also terminate your account at any time by cancelling your subscription.

10. Governing Law

These Terms are governed by the laws of Victoria, Australia.
